San Benito County prosecutors this week charged Hollister resident Shawn G. Bourdet on suspicion of felony counts alleging he caused injuries to a child in the July 4 fireworks incident on Brigantino Drive.
The district attorney’s office Monday filed charges against Bourdet, 35 at the time of the incident, more than four months after the suspected crime occurred.
Prosecutors alleged two felony counts of causing injury/health endangerment to a child, one misdemeanor count of discharging fireworks likely to injure someone, and one misdemeanor count of possessing fireworks without a permit, according to court records.
Bourdet is set to appear in court at 8:30 a.m. Dec. 1 in courtroom 3 before Judge Steven Sanders.
According to state law, he could face a year in county jail or up two to six years in state prison for the felony charge of causing injury
The district attorney’s office in early August had more questions on the July 4 fireworks-related incident involving injuries and referred the case back to Hollister police. The prosecution received the police report July 24, a deputy district attorney has confirmed.
Hollister police arrested Bourdet after the incident, and he later posted the $65,000 bail amount for release.
Police in their report alleged that Bourdet set off a large mortar device on the street at a large block party on Brigantino Drive. Once lit, the launcher fell over and injured at least five people, police reported.
Injuries included a broken leg and varying degrees of burns, according to police. All of the victims were expected to recover.
