County and law enforcement right to focus on zoning of Purple
Cross
As former owner of 1980 Bolsa Rd. I am thoroughly disgusted on
what is happening at that location. My father Del Martin Jr. owned
and operated Del’s Machine Shop at that location for many
years.
My husband and I inherited that property about 12 years ago, at
that time we were told by a former county supervisor that the
zoning was machine agricultural, any other type of business would
require rezoning of the property. After evaluating the cost of
re-zoning we then sold the property. It has changed hands once
since the sale, the current owner being Stan Smith.
I had spoken with former Supervisor Richard Scagliotti, when I
heard the rumor that Purple Cross was relocating from his Los Banos
property to the Bolsa Road property.
He told me that McPhail had to relocate due zoning issues in Los
Banos and Scagliotti gave him information on the Bolsa Road
property; so basically Scagliotti got rid of the problem and gave
it to someone else
– that someone being Stan Smith.
Stan obviously did not check zoning requirements and let McPhail
and Purple Cross begin business at 1980 Bolsa Rd. I was told
”
it’s just like the farmers on San Juan Hwy., they grow there
produce and sell it in their fruit stands,
”
however, produce is legal!
McPhail is packaging and selling medicinal marijuana at the
above location which does not fall into the agricultural
requirements. In speaking with him he states he is also going to
grow and sell produce and orchids as well.
My husband and I are doing everything we can to put a stop to
this business at that location unless McPhail goes through the
process of re-zoning as everyone else must do. It seems like he put
the cart before the horse you might say and opened without any of
the requirements. In doing research, it seems like this is how he
opens most of the business, which have then in fact all had to
move. I would think that would be quite costly!
I have had many discussions with the neighbors, as well as San
Benito County Building and Zoning Department, County Supervisor
Margie Barrios and law enforcement. Currently, Stan Smith has been
directed to issue McPhail a 30-day eviction notice and then the
process will begin. Everything seems to go through McPhail’s
attorney!
I am confident that the county and law enforcement will do
everything possible to follow the zoning requirements for 1980
Bolsa Rd. As for Stan Smith, the current owner, I can only hope he
will as well.

Plenty of ways to fix the state budget
Here’s some ideas to fix the state budget.
Severely CUT the budget, headcount, benefits and regulations associated with state agencies like the CalRecycle program where former tax hike legislator John Laird now hides with a BIG FAT salary. The only skill Mr. Laird has is in WASTE and should not be involved in an agency to reduce waste. There are so many employees at the CalRecycle agency, it’s annoying to count. I am sick and tired about hearing we have to cut police fire and schools. Another program to ELIMINATE is the program where people tattle on each other for a fire in their fireplace. Eliminate the hotline and people who drive around on spare the air nights trying to catch people trying to stay warm on the coldest nights. The list really is endless and need not be focused AT ALL on police fire and schools other than capping retirement benefits at say a current value of $70,000, not allowing collection of benefits till a reasonable retirement age without a massive penalty, remove the guarantee of the taxpayer for those benefits, the list really is endless and should be solely focused on the lifestyle of upper level government employees. The next place to start cutting is the California Air Resource Board and the Coastal Commission. But hey, cutting these agencies would eliminate power and we can’t have that. The budget is really not about the kids and police, it’s about guaranteeing a fat retirement at taxpayer expense. This paper and every other paper in the state as well as all the TV stations simply refuse to expose the waste, they would rather report on the police blotter, the homeless, school programs to cut, all of which requires little effort. What ever happened to real reporting that went after greed? Oops, only if it’s in the private sector.
