if convicted, according to law enforcement.

Alfredo Felito Guerra, 33, was charged with terrorist threats and threatening an officer after he leaned out of a car window and simulated shooting an on-duty detective not in uniform, said police spokesman George Ramirez.

Ramirez said Guerra was a passenger in a car that was stopped in a driveway and partially blocking the road in the 300 block of McCarthy Street around 2pm on Monday.

Guerra “violently thrust” his upper torso out the passenger window and began yelling at the detective “at of nowhere,” he said. The detective was in an unmarked police car behind the vehicle, Ramirez said.

The car drove away, stopped in the 200 block of Santa Ana Road, and when the three passengers got out Guerra was arrested and taken into custody, Ramirez said.

“The officer felt threatened by the suspect’s actions,” he said. “We’ve had numerous contacts with him and he’s had a history of running from police and resisting arrest. Due to his actions the officer felt his safety was compromised.”

District Attorney John Sarsfield said if Guerra is convicted he could face up to three years in prison, but was unsure whether the case will ever see the inside of a court room.

“I have no idea whether it will go to trial or not, it’s way too early to tell,” Sarsfield said. “You never know.”

Guerra was booked into the San Benito County Jail with no bail because of a probation violation, and has numerous prior bookings dating from 1992, according to jail personnel.

Guerra’s previous booking charges include resisting arrest, battery, vandalism and drunk in public, but no arrests for assault or attempted assault on a peace officer, according to jail personnel.
