A Hollister man has filed a claim against the city contending
that trees at an intersection created a hazard, causing an August
traffic accident and leading to injuries to the resident, according
to the claim.

Hollister City Council members were set to consider rejecting the claim – a standard practice – at their 6:30 p.m. Monday meeting. Claims are a necessary precursor to filing lawsuits.
The man, Bennie Padron, argues in the claim that the Aug. 2 accident at McCray Street and Gibbs Drive was due to trees there, and the document notes how those trees were removed after the wreck.
The claim reads: “The trees created a dangerous condition of public property at this intersection because a driver stopped at the limit line for westbound traffic on Gibbs drive could not see far enough down McCray Street to safely make a left hand turn onto McCray Street.”
In the claim, the resident, represented by local attorney Tab Mitchell, is asking for an amount in excess of $10,000.
