Police arrested a man for domestic violence just after midnight

Police arrested a man for domestic violence just after midnight this morning after he allegedly discharged a gun in his home while arguing with his wife and an unidentified person who was seeing either the husband or the wife.
Police arrested Kirk Janini, 41, at his residence along the 800 block of Welburn Avenue in north central Gilroy about 12:30 a.m. today. It was unclear who called police, but when they arrived it became apparent that Janini and his wife were arguing about their separation in front of a third person, who one of them was seeing, according to police. An unknown number of “friends,” including a juvenile, were also present during the dispute, according to a press release.
Janini was drunk and “became upset and brandished a handgun,” according to the press release. “There is conflicting information as to whether the weapon was pointed directly at Mrs. Janini or in her general direction. In any event, the third party grabbed Mr. Janini and the weapon as it discharged.”
It was unclear how many times the gun went off or what the bullet struck, but police said nobody was hurt. After the gunfire, the third party fled the residence with the weapon, according to the press release. The person, deemed a witness in this case, and the weapon he or she took, are both still missing, police said.
Police did not return phone calls Friday. The city was on its second furlough day of the new fiscal year.
