A local rooster rancher’s lawsuit challenging a San Benito County ordinance limiting the amount of crowing fowl he can keep on his property won’t go to court until October.

Frank Del Carlo filed a suit against San Benito County in 2006 for an anti-crowing ordinance it passed that year. The ordinance requires permits for property owners who want to keep more than six roosters.

On Monday, the suit was scheduled to be tried, but a conflict with a criminal matter caused its delay until Oct. 14.

The trial was pushed back to accommodate a witness the defense plans to call, said Del Carlo’s attorney, Bill Marder.

“We have a professor from U.C. Davis who is going to be testifying on our behalf,” Marder said.

Marder said the professor is a renowned chicken expert and has limited time to testify in court.
