“It’s really going to depend on what transpires,” California Highway Patrol Public Information Officer Terry Mayes said. “If the young boy dies, we’ll charge manslaughter, but if he lives, we’ll file a moving violation.”

The toddler was one of 10 victims in the two -car accident that occurred when San Jose resident Jose Moreno ran a red light in his 2004 Chevy Silverado truck and crashed into a 1996 Astro Van filled with eight people, all extended family members, at 12:30pm.

Everyone involved was rushed by helicopter and ambulance to several different hospitals in the area, and as of Friday, eight still remain hospitalized with minor to major injuries.

The 3-year-old’s father drove up from Santa Ana Thursday to be with his son, and his wife, who was also injured in the accident, but Mayes said they’re either in different hospitals or different wings of Santa Clara Valley Medical Center, so he can’t be with both of them at the same time.

Moreno was heading southbound on Fairview Road when he hit the van, and Mayes said he was going roughly 45 mph. Everyone involved in the accident was wearing their seat belts, according to the CHP.
