Garcia faces a life term if convicted of attempted murder for
allegations he shot his mother
Ruben A. Garcia, the 40-year-old Hollister man suspected of shooting his mother in the face, is unlikely to face additional charges stemming from the June 3 four-hour police standoff prior to his arrest, said San Benito County Deputy District Attorney Patrick Palacios.
“Given that he is being charged with attempted murder in the first degree, which carries a life without parole sentence, I think resisting arrest or delaying an officer charges are unnecessary,” Palacios said.
Palacios said he has not yet reviewed the case specifically but said since no one was hurt during the standoff, his office would likely stick with charges of attempted murder.
Police say Garcia shot his mom three times in the face, arm and hand after an argument over finances at their Brighton Drive home on June 1.
Garcia’s mother is expected to recover from her wounds after being treated in a Bay Area hospital.
Garica is thought to have fled immediately after the shooting, but a neighbor noticed his truck parked near Cerra Vista Elementary School and called 911.
The school was immediately locked down, the neighborhood was evacuated and more than a dozen officers were dispatched to coax Garcia out of the same Brighton Drive home where the suspected attempted murder took place.
After four hours, in which officers used a loudspeaker to demand that Garcia come out, he finally emerged and was taken into custody and booked into San Benito County Jail.
At an arraignment hearing at San Benito County Superior Court on June 5, Garcia pled not guilty to charges of attempted murder and a special allegation for committing a crime after already being convicted of a serious felony.
Garcia has been assigned a public defender and is scheduled to return to court June 12 for a preliminary conference.
