Hollister – Several members of the Frusetta family filed an answer Wednesday to a complaint alleging fraud in the sale of jointly held artwork.

The complaint was filed in early February on behalf of 81-year-old Fern Frusetta Fancher, alleging several family members had defrauded her of her share of the artwork.

Paul Rovella, who represents defendants Shirley Frusetta Tully, Leslie Frusetta Goss, Regan Tully and Zin Zan Inc., said his clients made the transaction in question in good faith.

Rovella does not represent Peter Frusetta, who has yet to answer the suit.

“They are pretty upset about the way that this has panned out,” Rovella said.

The response to the lawsuit stated that Fancher consented to the sale of the artwork and was not harmed by the defendants in any way.

Bill Marder, who represents Fancher, said she suffers from Alzheimer’s and can be taken advantage of easily. Marder said Fancher did not consent to the sale of artwork by Ed Borein for $12,000, which Fancher’s suit maintains is less than the art is worth.

No court date has been set to hear the lawsuit.
