Public defender Greg LaForge asked that the case be continued
until July 20 due to the fact that an expert is still investigating
the case. Judge Steven Sanders granted the request and scheduled a
continuation hearing for 8:30 a.m. July 20.
Cheryl Busch was back in San Benito County Superior Court today to have a trial date set for the case in which she is accused of shooting and killing her 19-month-old daughter in November 2008.
Public defender Greg LaForge asked that the case be continued until July 20 due to the fact that an expert is still investigating the case. Judge Steven Sanders granted the request and scheduled a continuation hearing for 8:30 a.m. July 20. The hearing is scheduled to last four hours.
Busch is charged with first-degree homicide in the shooting death of her 19-month-old daughter Donna Busch at the family’s home off Shore Road. She was arrested after telling a 911 operator, according to a transcript, that she had killed her child. Law enforcement arrived to find the toddler deceased with one gunshot wound to the head and one to the chest and the .357 Magnum nearby used to kill her. Busch has pleaded not guilty.
Prior to the proceedings, Busch sat with her head against the wall. LaForge also asked Sanders that she remain seated while the trial dates were discussed.
There will be a confirmation hearing at 9 a.m. on July 8, and bail remains at $1 million.
