Gonzalo Munguia, 19, and Emilio Roman, 18, were ordered in July to stand trial for the murder of fellow Hollister teenager Daniel Gallegos. Gallegos was killed in July 2006 after an altercation with Munguia and Roman.
Munguia and Roman will be back in court Oct. 1 when visiting San Benito County Court Superior Judge Alan Hedegard is expected to set a trial date.
After Gallegos’ death, the Hollister Police Department reported that Munguia and Roman used a car to run over the 18-year-old. But prosecution witnesses testified at court hearings in July that Munguia was driving and Roman was not in the car.
District Attorney Candice Hooper charged the teens with a special allegation contending they are Sureño street gang members.
The charge makes Munguia eligible for the death penalty if convicted. Hooper has said she will seek the death penalty for the 19-year-old.
