Hollister – Two male juvenile Hollister residents were arrested by Hollister police for committing a lewd act with a 13-year-old Hollister girl Saturday, according to police.

A 16-year-old was arrested for lewd conduct with a minor, sodomy, unlawful intercourse and possession of a controlled substance, all felonies, and a 17-year-old was arrested for lewd conduct with a minor, a felony, after an adult family member of the girl interrupted them in the act, said police spokesman George Ramirez.

“It was all consensual,” he said. “They were arrested because of her age.”

Police were called to the girl’s Memorial Street residence around 5pm after the two juveniles had attempted to flee from the home but were chased down and held by the girl’s family member, Ramirez said.

The girl was taken by police to a San Jose-area hospital where a sexual assault exam was performed, but she did not appear to have any injuries, he said.

Both juveniles were booked into the San Benito County Juvenile Hall. The names of juveniles are not released for confidentiality reasons. The Free Lance also doesn’t publish names of victims who are minors or those alleging to be victims of sexual crimes.

Generally, juvenile offenders are not required to register as sex offenders if it was a consensual situation and they are within three years in age of the victim, said District Attorney John Sarsfield.

Juveniles are usually only required to register if they are over 16 and sentenced to the California Youth Authority, which is a juvenile prison, Sarsfield said.

“The judge could do it, although it’s extremely unlikely,” he said.
