A trial is scheduled to start at 9 a.m. Monday for attorney Mike Pekin’s nearly 5-year-old civil action against former Supervisor Richard Scagliotti.

And as that court action is set to begin here, a federal judge recently dropped Pekin’s separate Civil Rights suit against San Benito County relating to the district attorney’s prosecution in 2005 of the lawyer, his son and another woman.

Pekin’s active suit in San Benito County began as an investigation and lawsuit from the anonymous group Los Valientes, but has morphed through the years and now is filed with Pekin’s son, Patrick, as the plaintiff.

The controversial case involves a long list of suits and countersuits revolving around accusations that Scagliotti abused his position to benefit his business interests as a developer. Scagliotti has denied all the allegations.

The trial starting Monday is set to cover just a portion – slightly more than a dozen – of the alleged counts against Scagliotti. Other facets of it are still at other stages of deliberations. Michael Serverian, the attorney representing Scagliotti and the county, said he expects next week’s trial to last five days.

Pekin filed the federal lawsuit – which was dropped last week – in late 2005 alleging county officials violated his Civil Rights along with those of this legal aide in retaliation for the Scagliotti suit.
