Hollister traditionally has required payment of development impact fees when building permits are issued, but now builders can wait until the end of the process after two companies protested the rule.

City officials made that decision last month after the two builders, KB Homes and Anderson Homes, opposed the timing of those impact fee payments as required by state law.

The Government Code states that residential builders do not have to pay the fees until final inspection or issuance of a certificate of occupancy, whichever comes first, according to a staff report for council members.

The change, however, does not allow for any adjustments to the timing for payment of school impact fees, the report notes.

As part of the council’s approval, the city agreed to refund the two development companies, which are set to remit the funds prior to final inspection.
