Hollister School District parent Brianna Rodriguez Tavares filed a formal complaint alleging students were being assigned detention during recess, which is an illegal procedure.
She spoke at Tuesday’s district board meeting and cited a section of education code, which states that students “shall not be required to remain in the school during the intermission at noon or during any recess.” The parent did not specify a school or schools where she claimed it was happening.
Trustees are not allowed to respond to public comment if the topic of discussion is not already on the meeting agenda. In this case, Superintendent Gary McIntire chose to address the issue briefly in his superintendent report at the close of the meeting.
“We’ll need to quantify and find out where these things are happening and to what extent,” McIntire told trustees, before saying he couldn’t address the issue more since it wasn’t on the meeting agenda. “We’ll be investigating.”
