Tobias granted defense attorney Arthur Cantu’s motion for a continuance after a lengthy debate with prosecutor Denny Wei that lasted for more than an hour, Cantu said.

Solorio was arrested July 1, 2002 after a struggle with Hollister Police Sgt. Greg Thul sent both men to the hospital with extensive injuries after crashing through a plate glass window.

Cantu asked for more time to secure medical records from Thul’s doctor, and to allow the FBI to complete an investigation they are executing on a videotape that is crucial to the defense, Cantu said.

The videotape, which allegedly recorded some of the struggle between Solorio and Thul, is now in Quantico, Va.

“It’s being examined for evidence of whether or not it was altered, edited or tampered with,” Cantu said.

The results of the FBI’s investigation are estimated to come back Dec. 8, he said.

The prosecution was ready for trial Dec. 1, but now they will prepare for the new trial date, Wei said.

“We weren’t asking for one, we were ready to go,” he said. “I respect the judge’s decision.”
