13-year-old boy, police said.
Gilroy police arrested a 49-year-old convicted sex offender for allegedly sending daily sexually explicit text messages to a 13-year-old boy, police said.
About 3:23 a.m., police went to Frank Mike Subia’s north Gilroy home at 8490 Wayland Lane to apprehend him, according to Sgt. Jim Gillio. He came out of his house to go to work and got into his car. Police then stopped the car at the intersection of Welburn Avenue and Hanna Street and arrested Subia without incident. Police booked him for contact of minor with intent to commit sexual offense and annoyance or molestation of a child under 18 by a convicted sex offender.
The victim knew Subia because they lived in the same neighborhood for several years, police said. Subia and the boy sent text messages to each other for some time, but on May 15 Subia’s text messages turned sexual, requesting sexual favors and propositioning the boy.
The boy did not engage in any sexual acts with the man and reported the crime immediately, police said.
“We were able to get phone records to confirm what the victim was providing us verbally,” Gillio said. “That was enough to set up and arrest him this morning as he left for work.”
In 2000, Subia was arrested by Gilroy police and convicted of having sexual intercourse with a 14-year-old girl.
