The man accused of barricading himself in a vehicle after a
domestic dispute has been charged on suspicion of one felony
– non-firearm assault with a deadly weapon – and three
misdemeanors, according to court documents.
The man accused of barricading himself in a vehicle after a domestic dispute has been charged on suspicion of one felony – non-firearm assault with a deadly weapon – and three misdemeanors, according to court documents.
Police arrested Sal F. Magallanes Jr. on Sept. 11 after police were dispatched to a residence in the 100 block of Rustic Street on the report of a family disturbance. It was reported Magallanes had assaulted one of his family members, causing serious injuries. Officers also were warned the suspect was possibly under the influence of illicit drugs and possibly intoxicated, along with acting irrationally and violent.
The suspect had barricaded himself in a vehicle at the rear of the residence and was in possession of a knife.
Officers negotiated with the suspect for approximately 45 minutes to get him to comply with requests for a peaceful surrender. During that span, the suspect repeatedly threatened to assault officers.
One of the officers got close enough to the suspect to take hold of him and pull him from the vehicle. The suspect then became combative and lunged toward the officers, swinging his arms and kicking his feet at them. An officer used his TASER on the suspect, who was taken into custody after a brief struggle.
The other charges stemming from the incident include battery on a peace officer, resisting an officer and vandalism under $400, all misdemeanors. Court documents alleged the vandalism charges came from the suspect tagging someone else’s guitar.
Magallanes was in San Benito County court on Sept. 15 for an arraignment hearing and is scheduled to be in court for a preliminary setting hearing Tuesday. The hearing is set to begin at 2 p.m. in courtroom 101 with Judge Steven Sanders presiding.
His bail was set at $21,000.
