Rodrigues was arrested Sept. 24 as he approached the county
courthouse to be arraigned on the three existing rape charges. The
new charges are alleging another rape count, several restraining
order violations and felony counts of possessing ammunition and a
firearm.
The case of former sheriff’s Sgt. Mike Rodrigues is set at 3 p.m. Wednesday for a discovery motion on three previous rape counts and for arraignment on a new rape allegation.

Rodrigues was arrested Sept. 24 as he approached the county courthouse to be arraigned on the three existing rape charges. The new charges are alleging another rape count, several restraining order violations and felony counts of possessing ammunition and a firearm.

Last week after the arrest, visiting Judge Richard Benett of Napa County released Rodrigues on his own recognizance as long as the 25-year sheriff’s office veteran promised to stay in the county. The Wednesday hearing will be in department 2A and will be overseen by Superior Court Judge Steven Sanders.

The discovery motion on the prior charges, said defense attorney Art Cantu, is a request by the defense that they be provided with a felony arrest report.

“We are asking for the investigation report that led to the felony arrest of a complaining witness,” said Cantu. “Prosecution has not provided it to us yet.”
