HOLLISTER
Former sheriff’s Sgt. Mike Rodrigues made an appearance in court Wednesday for the suspected four counts of rape and various weapons and family law violations for which he has been charged.
Defense attorney Art Cantu requested financial records of one of the suspected victims in the matter, and was told by Judge Harry Tobias that he would need to make a motion to compel the defense to provide such records. The judge also noted preliminarily that he did not believe the defense would be entitled to the documents.
Cantu also filed a demurrer on the illegal weapons and ammunition charges that resulted from Rodrigues being in possession of the items in violation of restraining orders. A demurrer is when an accusation is admitted to be factual, yet it’s claimed there’s no reason for legal action.
Assistant District Attorney Patrick Palacios said that prosecutors also criticized the defense’s continued use of proper names of victims, rather than referring to them as Jane Doe. According to Palacios, the judge concurred and advised Cantu that sanctions would be imposed if use of proper names continues.
Tobias continued the case until 3 p.m. Nov. 5.
