The former Hollister martial arts instructor accused of sexually assaulting a juvenile girl is scheduled for a preliminary examination Sept. 30, according to court records.
Timothy Gutierrez is scheduled for a pre-preliminary examination Thursday before a preliminary examination – where a judge can decide if there is enough evidence for a trial – at 8:30 a.m. Sept. 30 in room 101 at the courthouse before Judge Steven Sanders.
Hollister police officers in April arrested the 51-year-old man – then a martial arts instructor at Technique Studio on Sixth Street – on suspicion of sexually assaulting a female under age 14.
According to a police report, officers arrested him at the martial arts studio at 211 Sixth St. in Hollister. Police reported that the victim’s parent alleged there was inappropriate contact between the child, who was a student at the martial arts studio until her parents discovered the suspected inappropriate contact involving Gutierrez.
Police reported that an investigation by Hollister police, district attorney investigators and Child Protective Services staff members produced probable cause for an arrest.
Gutierrez was booked into the San Benito County Jail accused of one charge of lewd acts with a child and one charge of sexual penetration. He remains in custody with bail set at $550,000.
