GILROY – The Gilroy man who plead guilty in June to sexually assaulting an 11-year-old girl and attempting to sell the videotape to a co-worker was sentenced to 45 years to life in prison.
Pablo Enrique Castillo, 24, of Gilroy, was sentenced Monday morning in San Martin for committing four felonies, including three counts of aggravated sexual assault of a minor under the age of 14 and one count of creating child pornography for commercial purposes. Each count carried a 15-years-to-life prison term.
Castillo’s sentence of 45 years to life was part of a plea agreement with the district attorney. Castillo entered the guilty plea following opening arguments at his June 3 trial. Had the jury trial been completed, he could have faced 14 consecutive life terms if convicted.
Castillo will be eligible for parole once he has served 45 years of his sentence, according to Deputy Public Defender Kelly Paul. He will be 69 years old.
A parole board will hear arguments from his defense attorney and from the district attorney’s office to decide whether Castillo should be allowed back in the community. Victims of the crime or family members may also be heard.
“I would not expect (Castillo) to get paroled, given the nature of the case,” Deputy District Attorney Stacey Rubino said.
If he is not released, Castillo will have the right to a re-hearing and will be able to keep seeking parole until his sentence ends.
Castillo, who has been held in county jail since his arrest, will be transported to a prison facility to serve out his sentence.
Sheriff’s deputies arrested Castillo last October
following a tip from one of his Hollister co-workers.
The co-worker told authorities that Castillo tried to sell a tape showing Castillo engaged in sexual acts with the 11-year-old girl.
