A Hollister man was sentenced Thursday to nearly 10 years in prison for convictions related to a 2011 assault charge.
David S. Quintero, 36, was arrested after being accused in a sexual assault alleged in July 2011. A jury acquitted him on nine charges but did convict him on three of the related counts, including an assault allegation. Â
On Thursday, Judge Steven Sanders sentenced Quintero to nine years and eight months in state prison, according to court records. Quintero, meanwhile, was credited with 586 days of time served. He also had two other prior felony convictions for non-violent offenses.
Along with the prison sentence, Quintero was issued a no-contact order and is required to pay restitution.
The accuser, 32 at the time, called authorities the day after the encounter and reported that her ex-boyfriend, Quintero, sexually assaulted her after a verbal argument in the residence. According to investigators, the accuser alleged they got into a verbal argument and when she tried to leave, “Quintero physically and sexually assaulted” her.
The district attorney’s office initially charged Quintero on 16 related counts, many of them felonies, including a forcible rape charge. Prosecutors before the recent trial dropped five of the counts.
Quintero’s sentencing had been delayed twice before the hearing Thursday morning.
