Joe Perez, 30, was arrested for allegedly raping a 24-year-old Hollister woman on Nov. 30 while the two were at a dinner at Perez’s home with his family on Barnheisel Road, said Detective Sgt. Wes Walker.

Sometime between 9pm and 10pm, Perez and the woman went outside to a converted garage with a bedroom to watch home movies and had nonconsensual sex, Walker said.

Perez and the woman had known each other for some time, he said.

“She told him ‘no’ but it was not violent,” Walker said. “She resisted but he forced himself on her.”

The woman reported the rape on Thursday, Dec. 2 and was not taken to the hospital to receive a sexual assault test, Walker said.

Because of the delay, the sheriff’s department doesn’t have any physical evidence, he said.

Perez was booked into the San Benito County Jail for felony rape and is still in custody in lieu of $50,000 bail, according to jail personnel.
