The 28-year-old man accused of sexual misconduct with minors at the church grounds where his father is pastor waived his right to a preliminary hearing that was scheduled for today and he is set to appear again in court March 18, according to the prosecutor overseeing the case.
Ruben J. Matuk, of Hollister, waived that right for a preliminary hearing at which a judge would have decided if there was enough evidence for a trial. His next scheduled appearance is at 9 a.m. March 18 at the San Benito County Courthouse, for an arraignment on information, where Matuk could enter a plea.
Deputy District Attorney Karen Forcum said the case “could be resolved” before then and she noted how it is “pretty early in the process” when it comes to potentially settling on the charges.
He is accused of the acts with four female juveniles. Prosecutors alleged 14 felony and misdemeanor counts of lewd and lascivious acts, molesting, indecent exposure and sexual battery, according to records. Investigators allege the crimes occurred at the Apostolic Full Gospel Church of Christ, 1515 Santa Ana Road, and also at Matuk’s residence adjacent to the church address.
Judge Steven Sanders has issued four protective orders – the most recent Dec. 24 – barring Matuk from contacting the suspected victims and requiring him to stay at least 100 yards away from them.
Matuk remains free from custody and was released from the San Benito County Jail on Nov. 23 after posting bail, which had been set at $100,000, according to court records.
