Police had been searching for Albert Munoz, 22, after he sexually assaulted a 16-year-old girl, said Hollister Police Detective Tony Lamonica.

The police department, which had issued fliers to different surrounding agencies with Munoz’s picture on it, had been searching for him for the past three weeks in connection with the rape, Lamonica said.

An off-duty San Benito County Sheriff’s Deputy saw Munoz at Chili’s Restaurant in Gilroy on Tuesday evening and recognized Munoz as he was eating dinner, Lamonica said.

“He went to apprehend him and (Munoz) took off,” Lamonica said. “He saw what car he got into, so he called Gilroy PD and they caught him.”

Gilroy police notified the Hollister Police Department, who picked Munoz up in Gilroy and transported him back to Hollister.

He was then booked into the San Benito County Jail.

Munoz is still in custody in lieu of $100,000 bail.
