The attorney for the county woman suspected of killing her 19-month-old girl in November 2008 filed a motion today claiming she is incompetent to stand trial.

A judge followed up by appointing Cheryl L. Busch, 40, another doctor who will determine whether she is competent, said Gregory LaForge, the public defender representing her. Busch is accused of shooting and killing her daughter outside the family’s Shore Road home in November of last year.

If the doctor determines she is competent through a battery of tests, the court proceedings would continue. If not, Busch most likely would be sent to either Atascadero State Hospital or Patton State Hospital, LaForge said.

From there, it would be an indefinite stay until it is determined she is competent – meaning she has the basic ability to assist her attorney in the defense.
