David Quintero still faces sentencing on three lesser counts
A Hollister man accused on rape charges was acquitted on that and other related accusations. But a jury did find him guilty on three lesser charges, and the man faces sentencing in December.
David S. Quintero, 36, was arrested after being accused in a sexual assault alleged to occur in July 2011.
The accuser, 32, called authorities the day after the encounter and reported that her ex-boyfriend David Steven Quintero sexually assaulted her after a verbal argument in the residence, according to a statement from the sheriff’s office. According to investigators, the accuser alleged they got into a verbal argument and when she tried to leave, “Quintero physically and sexually assaulted” her.
The district attorney’s office initially charged Quintero on 16 related counts, many of them felonies, including a forcible rape charge. Prosecutors before the recent trial dropped five of the counts. The jury, meanwhile, found Quintero not guilty on nine other charges. The jury did find Quintero guilty on a lesser version of one of the acquitted counts – an assault charge – along with two others, making terrorist threats and disobeying a court order, according to records.
Quintero’s sentencing had been scheduled for this week, but was continued until 10 a.m. Dec. 13 in courtroom 101 before Judge Steven Sanders.
There is no estimated sentence listed in court records, while prospective sentences for each charge can depend on circumstances. Quintero also has two other prior felony convictions, for non-violent offenses.
His attorney in court filings has argued for a probation sentence, citing unusual circumstances in the case.
