The baby was one of 10 people who sustained between major and minor injuries in a two-car accident when San Jose resident Jose Moreno ran a red light in his Chevy Silverado pick-up truck and crashed into an Astrovan filled with eight people, according to the CHP.

“The child is the greatest concern,” said CHP Officer Terry Mayes.

Of the 10 people involved, only the driver and front passenger of the van were wearing seat belts, Mayes said. The child was secured in a car seat on the left side of the vehicle, which took the brunt of the impact, she said.

Several of the people in the van were taken to Hazel Hawkins Hospital and have been released, and the others are still in San Jose-area hospitals, Mayes said.

Injuries range from moderate complaints of pain to major body trauma and facial lacerations, according to the CHP.

The CHP will wait to charge Moreno with manslaughter because no one involved has died. If the baby survives, he will be charged with a moving violation, according to Mayes.
