The trial date for accused child killer Cheryl Busch is scheduled for Nov. 28, nearly three years after she was arrested on accusations she shot and killed her 19-month-old daughter in November 2008.

Busch will return to court on July 29, for a pretrial conference where she is expected to change her plea to not guilty by reason of insanity, public defender Greg LaForge announced in court Thursday. The change in plea will depend on a physiological report issued within the next month. Busch pleaded not guilty to the crime in 2008.

The trial was postponed after Busch was found unfit for it. She was admitted to Patton State Hospital on March 24, 2010. After nine months, the mental hospital ruled she fit for trial.

The criminal proceedings were restarted in March after San Benito County Judge Steven Sanders ruled her competent for trial.

Busch is accused of shooting and killing her daughter with a .357 Magnum that was found at the scene. On a transcript of the 911 call made about the incident in 2008, Busch told a dispatcher she killed her daughter.

If convicted of homicide, Busch could face 25 years to life in prison.
